Terms of use

1. Who can use Tadapool

You must be 18 or older. By creating an account you confirm that you are, and that any information you provide is accurate.

2. What Tadapool is — and what it is not

Tadapool is a shared record for group gifts: pools, contributions, gift ideas, votes and friend balances that everyone invited can see.

Tadapool is not a payment service, wallet, bank, escrow or money transmitter, and is not a party to any payment between members:

• Tadapool never touches the money. There is no payment processing, no card on file, no balance held by us.
• Amounts in the app are records that members type in. Recording a contribution moves no money; saying “count me in” charges nothing. Members pay each other directly, outside the app.
• Tadapool does not verify recorded amounts and does not guarantee that anyone pays anyone. Collecting, settling and any dispute about money are strictly between the members involved.
• “Held money” records between friends are the same thing: a mutual note that both sides confirm, not funds held by Tadapool.

3. Your account

Keep your credentials to yourself; you are responsible for what happens under your account. Your username identifies you to other members — pick one that does not impersonate someone else or infringe anyone's rights. One account per person.

4. Your content

What you put into Tadapool — pool names, contribution records, notes, gift ideas, payment instructions — remains yours. You grant Tadapool the licence needed to store it, display it to the pool's members and otherwise operate the service, and nothing more. We do not sell your content or use it for advertising.

You are responsible for what you post. Remember that everything in a pool is visible to all of its members, and that a pool link is an invitation: anyone who opens it joins the pool. Share links accordingly.

5. Acceptable use

Use pools for what they are for. Do not use Tadapool to:

• collect money for unlawful purposes, or run gambling, lotteries, raffles with paid entry, or investment schemes;
• deceive people about what is being collected or what it will be spent on;
• harass, defame or impersonate anyone, or post content that infringes someone else's rights;
• probe, overload or interfere with the service, or access other people's data.

Accounts that do these things can be suspended or removed — see section 7.

6. Other members

Pools are made of people you invited, or who were invited by someone you trust. Tadapool provides the shared record, but it does not vet members, mediate disagreements or enforce promises. If someone records a contribution and never pays, that is between you and them — though we recognise it is annoying, which is why the record shows who entered what.

7. Ending things

You can stop at any time: leave a pool, or delete your account in the app (Profile → Delete account). Deleted accounts are permanently erased within 30 days.

We can suspend or remove accounts that violate these terms or the law, and will tell you why unless the law prevents it. We may also discontinue the service; if that ever happens, you will get advance notice and a way to export your data first.

8. The service is provided as-is

Tadapool is free to use. We work to keep it reliable and your data safe, but the service is provided “as is” and “as available”, without warranties of any kind — express or implied — including fitness for a particular purpose or uninterrupted availability. Your statutory rights as a consumer are not affected by this section.

9. Limitation of liability

To the maximum extent permitted by law, Tadapool is not liable for indirect or consequential damages, lost profits, or loss of data beyond what reasonable backups would prevent — and above all, not liable for money that members owe each other, since Tadapool never holds or moves it. Where liability cannot be excluded, it is limited to the amount you paid to use Tadapool in the last twelve months (Tadapool is free, so: zero, except where the law sets a floor). Nothing in these terms excludes liability that cannot lawfully be excluded, including for intent, gross negligence, or death or personal injury.

10. App stores

The app is distributed through the Apple App Store and Google Play. Your download is additionally governed by the store's own terms, and Apple's standard Licensed Application End User License Agreement applies to the app copy on iOS. The stores are not parties to these terms and are not responsible for the service.

11. Changes to these terms

If these terms change in any way that matters, you will be notified in the app before the change takes effect, and continuing to use Tadapool after that date means you accept the new version. The date at the top always shows the current version.

12. Governing law and language

These terms are governed by the laws of Andorra. If you are a consumer, you also keep any protection granted by the mandatory laws of the country where you live, and you may bring proceedings there. These terms are drafted in English; translations may be provided for convenience, but the English version prevails.
